General Information
This privacy policy provides information on how MIC Invest AG (“MIC Invest”) collects and processes personal data.
“Personal data” means all information relating to an identified or identifiable natural or legal person. “Processing” refers to any handling of personal data, regardless of the means and procedures used, in particular the collection, storage, retention, use, modification, disclosure, archiving, deletion or destruction of personal data.
For certain data processing activities, such as in the context of entering into contracts with MIC Invest or in connection with MIC Invest websites (“MIC Invest websites”), additional provisions (such as terms of use) may apply. Furthermore, the “Customer Information” refers as a general notice on data protection to the applicable privacy policy on MIC Invest’s website.
If the data subject provides MIC Invest with personal data of other individuals (e.g. family members, colleagues or employees), the data subject must ensure that these individuals are aware of this privacy policy. Their personal data may only be shared with MIC Invest if the data subject is authorized to do so and if this personal data is accurate.

Collection and Processing of Personal Data
MIC Invest primarily collects and processes personal data that is provided to MIC Invest by the data subject, e.g. when establishing business relationships, executing contracts, using products and services or through websites or other applications. MIC Invest also processes personal data that arises in the course of using products or services and is transmitted to MIC Invest, e.g. in payment transactions, securities trading, e-banking, via websites or during cooperation with other financial or IT service providers, marketplaces and exchanges. Where permitted, MIC Invest may obtain personal data from publicly accessible sources, authorities or other third parties.
Categories of Personal Data
MIC Invest processes various categories of personal data. The most important categories are the following:
Master and account data (e.g. name, address, nationality, date of birth, social security number, tax identification number, information regarding accounts, securities accounts, concluded transactions and contracts, information about third parties also affected by data processing such as spouses, authorized representatives and advisors)
Technical data (e.g. business numbers, IP addresses, internal and external identifiers, access logs)
Transaction or order and risk management data (e.g. information on transfer beneficiaries, beneficiary bank, transfer amounts, investment product information)
Financial data (e.g. creditworthiness data, information on assets, liabilities, risk and investment profile)
Visitor and prospect data (e.g. visitors to MIC Invest or MIC Invest websites)
Marketing data (e.g. preferences, needs)
Communication data (e.g. contact data such as email address, phone number)
Other data (e.g. video or audio recordings, access data)
Much of this data is provided directly to MIC Invest by the data subject. Categories of personal data received by MIC Invest from third parties include, in particular, information from public registers, information obtained in connection with official and legal proceedings, credit ratings, information related to compliance with legal requirements such as fraud, money laundering and counter-terrorism measures and export restrictions, information from banks, insurers and distribution and other contractual partners of MIC Invest regarding the use or provision of services, information from media and the internet, address and if applicable interests and other sociodemographic data (especially for marketing and research) and data related to the use of third-party websites and online offerings where such use can be attributed to the data subject.
Purposes of Processing
MIC Invest processes personal data primarily for the provision of its own services, the execution of contracts with business partners and customers, and for compliance with legal obligations. Furthermore, MIC Invest processes personal data, where permitted and indicated, for the following purposes:
Conclusion and fulfillment of contracts, implementation, execution and management of products and services (e.g. asset management, accounting, tax returns, commercial register entries and amendments, invoices, account openings, payments, financing, financial planning, investments, pension plans, insurance, consolidation)
Monitoring and control of risks (e.g. investment profiles, anti-money laundering, limits, utilization ratios, market, credit or operational risks)
Statistics, planning, business decisions (e.g. development of new or evaluation of existing services, products, processes, technologies)
Marketing, communication, information about service offerings and review thereof (e.g. advertising in print and online, customer, prospect or other events, determination of future customer needs, assessment of customer, market or product potential)
Fulfillment of legal or regulatory disclosure, information or reporting obligations to courts and authorities, fulfillment of official orders (e.g. reporting obligations to FINMA and foreign supervisory authorities, automatic information exchange with foreign tax authorities, orders from prosecutors related to money laundering and terrorism financing)
Prevention and clarification of criminal offenses or other misconduct (e.g. through internal investigations)
Protection of interests and securing the claims of MIC Invest, e.g. in the case of claims against MIC Invest or claims of MIC Invest against third parties
Ensuring operations, especially IT, the website and other platforms
Preparation and execution of transactions related to the purchase or sale of companies or parts of companies or other corporate transactions
Where consent has been given for the processing of personal data for specific purposes (e.g. signing up for a newsletter), MIC Invest processes the personal data within the scope and based on this consent, unless another legal basis applies and is necessary. Consent may be revoked at any time, but this does not affect data processing that has already taken place.
Data Security
MIC Invest is committed, in accordance with applicable laws and particularly data protection law, to protecting personal data and privacy. To this end, MIC Invest implements appropriate technical and organizational security measures (e.g. access restrictions, firewalls, personalized passwords, encryption and authentication technologies, employee training etc.).
Disclosure to Third Parties and Data Transfers Abroad
MIC Invest discloses personal data in the following cases to the following third parties (recipients):
For outsourcing according to section 8 and for customer support to other service providers, such as operators of Portfolio Management Systems (PMS) and Customer Relationship Management Systems (CRM)
For the execution of orders, i.e. when using products or services, e.g. to service providers, stock exchanges or marketplaces, reporting of stock exchange transactions to (international) transaction registers
Due to legal obligations, legal justifications or official orders, e.g. to courts, regulatory authorities, tax authorities or other third parties
Where necessary for the protection of legitimate interests of MIC Invest, e.g. in the event of legal actions threatened or initiated by customers against MIC Invest, public statements, to secure claims of MIC Invest against customers or third parties, for the collection of MIC Invest’s receivables etc.
With the data subject’s consent to other third parties
Recipients of personal data are usually located domestically. In particular, when using certain MIC Invest products or services, personal data may also be disclosed to third parties outside Switzerland (e.g. Europe or the USA).
If a recipient is located in a country without adequate data protection, MIC Invest contractually obliges the recipient to comply with applicable data protection (e.g. using standard contractual clauses), unless the recipient is already subject to a legally recognized framework ensuring data protection or MIC Invest can rely on an exemption clause.
Outsourcing of Business Functions or Services (Outsourcing)
MIC Invest outsources certain business areas and services wholly or partially to third parties (such as account management including payment processing, custody services, preparation of consolidation reports, creation of securities, updating of restriction rules, IT systems etc.).
Service providers who process personal data on behalf of MIC Invest (so-called processors) are carefully selected. Wherever possible, MIC Invest uses processors domiciled in Switzerland. The processors may themselves be authorized to provide certain services (e.g. electronic data processing, securities settlement etc.) via third parties.
Processors may only process personal data received in the same way MIC Invest would and are contractually obligated to ensure confidentiality, banking secrecy and data security. Outsourcing by MIC Invest is carried out, where applicable, in accordance with the FINMA Outsourcing Circular in its current version.
Automated Individual Decision-Making Including Profiling
MIC Invest reserves the right to process personal data automatically in the future, particularly to identify key personal characteristics of customers, predict developments and create customer profiles. This is particularly aimed at reviewing and further developing offerings and optimizing service delivery.
Use of Websites and Cookie Policy
When a person visits MIC Invest websites, the web server automatically records details of their visit (e.g. the website from which the visit originated, the visitor’s IP address, the contents of the MIC Invest website that are accessed, including date and duration of the visit). Such tracking data is used to optimize MIC Invest websites and provides information about how visitors learn about and use MIC Invest’s products, services and offerings. However, such data usually does not allow conclusions about the identity of the visitor. In this respect, no personal data is processed.
However, if the visitor provides personal data, for example by filling out a registration form or message field for a newsletter etc., MIC Invest may use this data, in addition to the purposes mentioned in section 5, especially for the following:
for customer and user administration
for informing the visitor about services and products
for marketing purposes (e.g. sending newsletters)
for technical hosting and further development of MIC Invest websites
When visiting MIC Invest websites, the visitor’s data is transmitted over the Internet, an open network accessible to everyone. Data transmitted via electronic media (including email) cannot be effectively protected against access by third parties. This entails, among other things, the risk that the data may be disclosed or altered, that the identity of the sender (e.g. email) and the content of the message may be forged or misrepresented.
